- In connection with the existing relationship between you and Imoti komfort-Sliven Ltd (hereinafter referred to as "the Parties") and in view of the forthcoming entry into force of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), we hereby inform you of the following:
- The Parties shall process the lawfully provided personal data ("Personal Data") of the other Party's employee-contact persons, as well as of the persons representing the other Party, solely and exclusively for the purposes of the performance of the contract/undertakings (exchange of information, data, communication, etc.) and neither Party shall be entitled to process the provided Personal Data for any other purposes. The processing of Personal Data by the Parties shall take place within the territory of the Republic of Bulgaria.
- Each Party shall notify the other in the event that it becomes aware of any breach of security of the processing of Personal Data. Notification of a security breach should be made as soon as possible to the other Party and should contain at least the following information:
- a description of the nature of the breach and of the facts relating to the personal data breach, including, if possible, the categories and approximate number of data subjects affected and the categories and approximate number of personal data records affected;
- a description of the possible consequences of the personal data breach;
- a description of the measures it has taken or proposes to take to address the personal data breach, including, where appropriate, measures to mitigate any adverse effects.
4.Each of the Parties shall compensate for the damages that a person may suffer as a result of unlawful processing of Personal Data by either of them, which processing violates Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data or other applicable legal provisions on the protection of personal data, unless the latter proves that it is in no way responsible for the damages.
5.The parties shall not be entitled to disclose to third parties the personal data provided, unless this is necessary for the performance of the contract.
6.Each party shall strictly comply with the legislation in the field of personal data protection.
7.We hereby acknowledge that you have been expressly notified of, understand, accept and agree to the contents of this notice and the consequences thereof.
